Waivers
Violations of the Immigration and Nationality Act or certain criminal convictions may prevent persons from obtaining lawful status in the United States. For example, prior removal/deportation orders, prior unlawful presence in the United States, alien smuggling, misrepresentation/fraud when applying for an immigration benefit, or certain convictions may bar persons from obtaining permanent residence. Federal law however grants these noncitizens the opportunity to apply for a waiver to overcome the legal barrier to lawful status. Our office has significant experience assisting clients in preparing waiver applications and effectively demonstrating hardship and entitlement to such waivers.
